How the letter works

The Rules Behind the Letter

The welcome is good practice. The owner contact form that goes with it is something the law asks for every year.

Most of the letter is simply good practice. A few lines reflect what California law requires.

  • Owner contact information. Each year the association must ask every owner for a preferred and an alternate way to receive notices, a legal representative if any and whether the home is owner-occupied, rented, vacant or undeveloped. The request must say an email address isn’t required and give an easy written way to change methods. If an owner doesn’t respond, notices go to the last mailing address on file or the property address (section 4041).
  • Individual delivery. An owner can ask to receive general notices, such as meeting notices, individually. The annual policy statement must describe this option (section 4045).
  • Board meetings. Owners may attend board meetings except executive sessions and may speak at them (section 4925). Notice goes out at least four days before a board meeting, or two days before a meeting held only in executive session (section 4920).
  • Pets. When the governing documents were adopted or changed on or after January 1, 2001, the association can’t prohibit an owner from keeping at least one pet, but it can adopt reasonable rules (section 4715).
  • What’s good practice. The welcome itself, the assessment summary, the contacts and the living-here notes aren’t legally required. They answer a new owner’s first questions in one place.

How to use it

Sending a Welcome That Works

Send it soon after the sale closes, while the new owner is still learning the routine.

These steps are good practice, not legal requirements.

  1. Watch for new owners. Keep an eye on escrow requests and ownership changes so the letter goes out soon after closing.
  2. Fill in the basics once. The tool saves your association details, so each new letter only needs the owner’s name and address.
  3. Attach the documents. Include or link the CC&Rs, bylaws, rules and the current annual budget report and policy statement. The California HOA Compliance Calendar shows when each annual disclosure goes out.
  4. Include the owner information form. Enter the response in the association’s records so notices reach the new owner the way they prefer.
  5. Point to the approval process. New owners often plan projects right away. The Architectural Application Template makes requests clear from the start.
  6. Invite them in. Mention the next board meeting and any committees or events, and add a personal note.
