San Marcos HOA Guide: Local Rules for Boards and Owners
San Marcos is a city of about 94,900 residents in San Diego County, and it administers an unusually long list of special tax districts. Some rules that matter to boards, like tree permits and watering schedules, we could not confirm.
This guide collects the city rules a San Marcos board is most likely to run into, says plainly where we could not confirm a rule, and points you to the How2HOA guide that explains what to do about each one.
Local rules on this page were checked against City of San Marcos pages, the Vallecitos Water District, San Diego County and the Census Bureau on October 26, 2026. The city’s tree code and its irrigation runoff page would not open, and we left out a Vallecitos watering page that cites a 2017 vote and may be outdated, so this page covers only what we could confirm on official pages. Confirm the current rule before you act on it. Sources are listed at the bottom of the page.

Local rules
Rules that apply in San Marcos
City ordinances apply on top of your CC&Rs, and state law comes first, mainly the Davis-Stirling Act. Where a city page left a question open, we say so rather than guess.
Short-term rentalsThe city says they are not permitted in residential zones.
The city’s Transient Occupancy Tax page states that short-term rentals are not permitted in residential zones. A Conditional Use Permit may be accepted in certain zones only if the use is consistent with a bed and breakfast. That means one living unit, an owner or manager in residence, and no more than five guest rooms.
The Transient Occupancy Tax rate is 10%. We could not confirm the code section that holds the prohibition, or how the city treats HOA rules. Call Planning at (760) 744-1050, ext. 3204.
What to do about it: see Rental Residence in HOAs and HOA Renters. For the California rules, see our guide to buying, selling and renting in a California HOA.
Parking and RVs72 hours on public roads, and no RVs on residential streets at any time.
The city’s parking page sets these rules for public streets:
- No vehicle may be parked at one location on a public roadway for more than 72 hours.
- RVs and mobile living units may not park on residential streets at any time (SMMC 12.20.160(a)). They may not park on any city street or alley from 2 a.m. to 6 a.m.
- Heavy-duty commercial vehicles may not park in residential areas, except to load, unload or answer a service call. Unattached semi-trailers and dollies are covered too. Camping and utility trailers are exempt.
- Street sweeping signs mean no parking on the posted days and times.
The page does not address private HOA streets or city enforcement agreements. Code Compliance, which covers private property only, is at (760) 744-1050, ext. 3206. Citation questions go to ext. 4517.
What to do about it: for private streets, How to Set Up a Towing Service in Your HOA and HOA Rules and Enforcing Violations. For the state rules on enforcement, fines and hearings, see California HOA enforcement, fines and disputes.
Noise, yards and treesCode Compliance enforces noise and property maintenance. Tree rules for HOAs are unconfirmed.
The city’s Code Compliance page says noise falls under SMMC Chapter 10.24. Property maintenance, such as overgrown yards, junk, stored vehicles and neglected landscaping, falls under Chapter 10.48. Zoning, parking and water-efficient landscaping fall under Title 20. The city does not accept anonymous reports.
SMMC Chapter 14.20 covers planting, trimming and removal of trees and shrubs, and Public Works has a tree policy. Neither would open for us, so we could not confirm how they apply to HOA slopes or common areas. We also could not confirm construction hours or leaf blower rules.
What to do about it: see How to Enforce the Rules in Your HOA and How to Hire a Contractor for Your HOA.
Water and rebatesThe Vallecitos conservation page lists free audits and a turf rebate.
We could not confirm which water agency serves each San Marcos address, so check your bill. The Vallecitos Water District’s conservation page says permanent water-use restrictions apply to all of its customers at all times. It offers a free Landscape Irrigation Audit. Call (760) 744-0460.
The district’s rebate page lists a turf replacement incentive of $1.75 per square foot through the San Diego Sustainable Landscapes Program. It requires rainwater capture, soil enhancement, climate-appropriate plants, efficient irrigation and a site inspection, and funding is limited. The page does not say whether HOAs qualify.
We are not stating watering days or hours. The district page that lists them cites a 2017 vote, and we could not confirm it is current. Ask the district for today’s rules.
What to do about it: plan irrigation changes with Planning Your HOA Budget and HOA Maintenance. For the California rules behind these projects, see California HOA maintenance and repair responsibilities and California HOA reserves.
Wildfire defensible spaceThe city runs an annual vegetation program. Confirm distances with Fire Prevention.
The city’s Community Wildfire Mitigation page describes defensible space in zones. It lists a landscape zone of 30 to 50 feet and a reduce-fuel zone to a 100-foot minimum for structures built before January 1, 2004, or 150 feet for those built after. It also describes Zone 0, the first five feet, with no compliance date.
A city ordinance prohibits accumulations of weeds, grass and vegetation. The Fire Department inspects properties in an annual vegetation management program, and the page publishes no dates. Report weeds at (760) 744-1050, ext. 3409.
Fire Prevention, at ext. 3400, takes requests for AB 38 defensible space inspections. The pages do not mention HOA-maintained fuel modification zones, so ask who owns yours.
What to do about it: build the work into your yearly plan with the Annual HOA Budget Checklist and HOA Maintenance. For what the association’s insurance has to cover, see California HOA insurance requirements.
City special tax districtsThe city administers ten Mello-Roos districts.
The city’s Finance page lists these community facilities districts:
- CFD 88-1 (Paloma and Santa Fe Hills)
- CFD 91-01 (Twin Oaks Valley Ranch)
- CFD 91-02 (Police and Fire)
- CFD 98-01 (Police and Fire) and 98-01 IA 1 (Police)
- CFD 98-02 (Lighting and Landscaping)
- CFD 99-01 (San Elijo Hills)
- CFD 2001-01 (Fire)
- CFD 2002-01 (University Commons)
- CFD 2011-01 (Congestion Management)
The County Auditor’s fiscal year 2025-26 list also shows many San Marcos CFD 98-02 and 99-01 improvement areas and San Marcos Unified School District districts. Questions go to the city’s CFD administrator at (760) 744-1050, ext. 4506. We did not find landscape districts beyond these.
What to do about it: a special tax matters at resale. See California HOA Annual Disclosure Calendar and What You Need to Know Before You Buy in an HOA.
