Sebastopol HOA Guide: Local Rules for Boards and Owners

Sebastopol is a small west Sonoma County city of about 7,500 residents on 1.88 square miles, with an owner-occupied housing rate of 56.3%. The city pumps its own water from wells, and since 2025 its fire service has come from the Gold Ridge Fire Protection District.

This guide collects the city rules a Sebastopol board runs into most often, and points you to the How2HOA guide that explains what to do about each one.

Local rules on this page were checked against the Sebastopol Municipal Code and the websites of the City of Sebastopol and the Gold Ridge Fire Protection District on October 10, 2026. Cities amend their codes often, so confirm the current rule before you act on it. Sources are listed at the bottom of the page.

At a glance

HOAs in Sebastopol at a glance

No public agency publishes a count of Sebastopol’s HOAs or a typical dues figure, so we do not quote one. The city’s Housing Element, adopted in January 2023, describes a small housing stock: 3,333 occupied homes, 1,661 of them owner-occupied and 1,672 rented. Its housing table counts 386 attached single-family homes and 996 multifamily units. It also says only 155 homes were added between 2000 and 2020, most of them single-family.

City planning records name a few places where shared ownership shows up:

The Canopythe city’s development projects page lists a proposal for 80 townhome-style condominiums on a vacant 6.1-acre site at 1009-1011 Gravenstein Highway North.
Small townhome projectsthe same page lists Huntley Square, an approved 10-unit “mini-townhome” project at 7950 Bodega Avenue.
CohousingPlanning Commission minutes from March 9, 2021 record a cohousing presentation by two residents of Two Acre Wood, and name Sequoia Village in Sebastopol.

To see how any community is governed, read its recorded documents. One charge is easy to confuse with dues. When Sebastopol joined the Gold Ridge Fire Protection District, the district’s parcel taxes were extended to city properties, about $265 a year for a typical single-family home. That charge is on the property tax bill and is separate from association assessments.

Local rules

Rules that apply in Sebastopol

Three layers of rules apply to a Sebastopol association. State law comes first, mainly the Davis-Stirling Act. City ordinances apply to every property, whether or not it is in an HOA. Your governing documents can then be stricter than the city in most areas, and state law limits them in a few. The city does not enforce your CC&Rs, and your CC&Rs do not excuse anyone from a city rule.

Vacation rentalsThe city allows hosted rentals with a permit and discourages full-time ones.

Vacation rental rules are in Municipal Code section 17.260.060. The city defines a vacation rental as the rental of a private residence for 30 days or less. It allows hosted rentals with a permit. It discourages non-hosted, full-time rentals and requires a conditional use permit for any new one. Staff can approve two types with an administrative permit:

Hostedno limit on the number of days. Two bedrooms at most, and the owner must live on site in a bedroom that is not rented. Three off-street parking spaces in total.
Non-hostedlimited to 30 days of rentals a year in total. The owner does not have to live on site, and one off-street parking space is needed for each sleeping or guest room.
  • The owner or an agent must be reachable by phone 24 hours a day while the home is rented.
  • An ADU built after July 1, 2017 may not be a vacation rental without a conditional use permit.
  • Vacation rentals need a business license and are subject to the city’s transient occupancy tax.

Ask Planning at (707) 823-6167 about the permit for a particular home. A city permit does not override your CC&Rs. If your documents restrict short stays, the association enforces that itself.

What to do about it: How to Handle Short-Term Rentals in Your Community walks through writing and enforcing a rental rule. For the California rules, see our guide to buying, selling and renting in a California HOA.

Accessory dwelling unitsADU rules are in Municipal Code Chapter 17.220, and review is ministerial.

Sebastopol’s ADU rules are in Municipal Code Chapter 17.220. Review is ministerial: staff check the plans against the standards and there is no public hearing. The main points in section 17.220.020:

  • On a single-family lot the code allows an ADU, a junior ADU and a detached new ADU of up to 800 square feet.
  • On a lot with existing multifamily housing it allows up to eight detached ADUs, as long as they do not outnumber the existing units, plus one attached ADU for every four existing units.
  • ADUs have no parking requirement.
  • ADUs on multifamily parcels may not be rented for less than 30 days.

The multifamily allowance matters to condominium and townhome boards. Read your documents with your attorney before you answer an application.

What to do about it: update your architectural process with How to Propose Changes to Your Property in a Homeowners Association. For how architectural review works under California law, see California HOA architectural review and owner rights.

Parking and RVsA 72-hour street limit, plus a separate RV parking chapter adopted in 2022.

Two chapters of the Municipal Code cover the questions boards ask most:

72-hour rule (section 10.36.050)no vehicle may be parked on a street, alley or city-owned lot for more than 72 consecutive hours. It counts as not moved if it is inoperable or has not traveled at least one mile. After a warning notice is posted, it can be towed 72 hours later.
RVs (Chapter 10.76)an RV may not be parked on a public street zoned residential at any time, on streets in commercial, industrial and community facility zones between 7:30 a.m. and 10:00 p.m., or within 30 feet of a street corner. The ordinance took effect on March 26, 2022.
RV exceptions (section 10.76.050)a homeowner, tenant or out-of-town visitor may park an RV on a residential street for up to 72 hours to load or unload.

Both rules are written for public streets and city lots. If your association owns its streets, parking is governed mainly by your own rules and by state towing law. On public streets, the city sends reports of vehicles parked over 72 hours and RV parking to the Police Department at (707) 829-4400.

What to do about it: How to Set Up a Towing Service in Your Homeowners Association. For the state rules on enforcement, fines and hearings, see California HOA enforcement, fines and disputes.

Water and landscapingSebastopol supplies its own water from city wells.

Sebastopol runs its own water utility. The city says its water is produced by a series of wells located throughout the city and stored in two reservoir facilities. Wastewater is piped to the City of Santa Rosa’s subregional treatment system.

Drought rules are in Municipal Code Chapter 13.06, the Water Shortage Contingency Plan. It sets six stages, and the City Council starts and ends a stage by resolution. The city’s water pages do not state which stage, if any, applies today, so call Public Works at (707) 823-5331 before you change planting or irrigation.

The only rebate on the city’s utilities page is for toilets: a one-time $150 credit on the water and sewer bill for replacing a toilet that uses 3.5 or 7 gallons per flush, or $75 for replacing a 1.6-gallon toilet with one that uses 1.3 gallons or less. Only models on the Sonoma County Water Agency’s list qualify, an inspection is required and funding is limited. The application is written for property owners, so ask the Building Department at (707) 823-8597 whether an association account qualifies.

What to do about it: put landscape and plumbing upgrades in your numbers with Planning Your HOA Budget, then compare bids with the Vendor Comparison Worksheet. For the California rules behind these projects, see California HOA maintenance and repair responsibilities and California HOA reserves.

TreesThe permit threshold is lower on multifamily property than on a single-family lot.

Tree rules are in Municipal Code Chapter 8.12. The threshold depends on the kind of property, and diameter is measured four and a half feet above the ground.

PropertyPermit needed to removeWho decides
Single-family or duplexAny tree with a trunk of 20 inches or moreCity Arborist
Multifamily, commercial or industrialA protected native tree of 10 inches or more, or any other tree of 20 inches or moreTree Board, after a public hearing

Protected native species include coast live oak, valley oak, black oak, madrone, bigleaf maple, California bay and coast redwood. No permit is needed to prune less than one-third of the crown, or to remove a tree that city staff find is dead, extremely diseased or an immediate danger.

The code does not mention association common area. A condominium or townhome board should assume the 10-inch threshold and the Tree Board hearing apply until Planning says otherwise. Call (707) 823-6167 before any removal.

Each application carries a fee of $75 per required replacement tree, refunded if the applicant plants at least two 15-gallon trees from the city’s list.

What to do about it: build tree work into your vendor process with Managing Outside Vendors for Your HOA. For who pays, read Who Pays for Repairs in an HOA?.

Weeds, vegetation and wildfireWeeds are a nuisance under Chapter 8.56, and Gold Ridge now provides fire service.

Municipal Code Chapter 8.56 makes weeds the owner’s job. Section 8.56.030 says no owner or person in control of a lot may let weeds remain on the property or on the sidewalk and strip out to the curb line. That covers association common area too.

The 2025 season shows how the process runs. The staff report took the weed resolution to the council on May 20, set the hearing for owners for June 17 and gave July 30 as the date after which a contractor would clear remaining lots. Owners are billed for the work plus administrative costs. Dates are set each year, so confirm the current ones.

The city’s Fire Department page now says the Gold Ridge Fire Protection District provides city fire services, after the county’s Local Agency Formation Commission approved the reorganization in 2025. Call Gold Ridge at (707) 823-1084 with fire prevention questions.

The council adopted the City of Sebastopol Fire Hazard Severity Zones map by Ordinance 1157 on June 17, 2025. The staff report says about 322 acres of the city are in the Moderate zone and no part is in the High or Very High zone. It adds that properties in those two zones carry extra defensible space and sale disclosure duties.

What to do about it: schedule mowing and clearance through HOA Maintenance and Vendors. For what the association’s insurance has to cover, see California HOA insurance requirements.

Noise and work hoursThe noise ordinance is Chapter 8.25, with daytime hours that set the limits for construction.

Sebastopol’s noise ordinance is Municipal Code Chapter 8.25. Section 8.25.060 sets the limits:

Residential and commercial zones55 dBA in the daytime and 45 dBA at night
Daytime hours7:00 a.m. to 8:00 p.m. Monday to Friday, 8:00 a.m. to 5:00 p.m. Saturday and Sunday
Construction equipmentexempt from the limits during daytime hours only

Contractors working in your community should keep to the daytime hours. An association that wants shorter hours or quieter equipment can write its own rule. The city sends residential noise complaints to the Police Department at (707) 829-4400 and construction noise complaints to the Building Department at (707) 823-8597.

What to do about it: write work hours into your rules with How to Enforce HOA Rules in Your Homeowners Association.

Quick answers

Questions Sebastopol board members ask

Does a city vacation rental permit override our CC&Rs?

No. The city permit and your governing documents are separate, and the city does not enforce CC&Rs. Ask your attorney how far your documents and state law let the association restrict short stays.

Do we need a permit to remove a tree in the common area?

Assume yes for a protected native tree of 10 inches or more and for any tree of 20 inches or more. The code applies the lower threshold to multifamily property and does not mention common area, so confirm with Planning at (707) 823-6167 first.

Who is our fire agency now?

The Gold Ridge Fire Protection District. The city’s Fire Department page says Gold Ridge provides city fire services, and the district’s phone number is (707) 823-1084.

Will the city tow from our private streets?

Do not count on it. The 72-hour rule and the RV chapter are written for public streets, alleys and city lots. See How to Set Up a Towing Service in Your Homeowners Association.

Is any part of Sebastopol in a Very High Fire Hazard Severity Zone?

No, according to the staff report for the map the council adopted in June 2025. It places about 322 acres in the Moderate zone and none in the High or Very High zone.
