Tesoro Viejo HOA Guide: County Rules and the Water Company

Tesoro Viejo is a master-planned community in unincorporated southeastern Madera County, so County of Madera rules apply, not a city’s. Its water, sewer and recycled water service comes from the Tesoro Viejo Master Mutual Water Company, which sets its own rates and watering schedule and hires Cal Water to run the systems.

This guide collects the County and water company rules a Tesoro Viejo board runs into most often, and points you to the How2HOA guide that explains what to do about each one.

Facts on this page were checked against the County of Madera’s website and Public Works budget documents, California Water Service’s Tesoro Viejo pages, the Tesoro Viejo Master Mutual Water Company’s watering schedule and rate resolutions, the State Fire Marshal and CAL FIRE on November 3, 2026. The County Code would not open for us, so this page does not summarize County noise, parking or weed abatement rules. We did not find Census QuickFacts figures for Tesoro Viejo or an official list of its community facilities districts. Confirm the current rule before you act on it. Sources are listed at the bottom of the page.

HOAs in Tesoro Viejo at a glance

Tesoro Viejo has no city government. The County, a mutual water company and a County service area each handle part of what a city would do:

UnincorporatedCounty of Madera departments handle planning, building permits and code enforcement.
County Firethe Madera County Fire Department serves unincorporated areas under a contract with CAL FIRE.
Mutual water companythe Tesoro Viejo Master Mutual Water Company provides water utility service, and its board adopts the rates and watering rules.
Cal Water runs the systemsCalifornia Water Service operates the water, wastewater, recycled water, storm water and farm water systems for the company.
County Service Area 22ECounty Public Works lists a Tesoro Viejo service area in its special district budgets.

Tesoro Viejo is in Madera County, so City of Madera and City of Fresno rules do not apply. This page gives no population or owner-occupancy figures, because Tesoro Viejo is not a city and we did not find Census QuickFacts figures for it. The County enforces its ordinances, and your association enforces its own governing documents.

Local rules

Rules that apply in Tesoro Viejo

Three layers of rules apply to a Tesoro Viejo association. State law comes first, mainly the Davis-Stirling Act. County of Madera ordinances apply to every property in unincorporated Tesoro Viejo, whether or not it is in an HOA. Your governing documents can then be stricter than the County in most areas, and state law limits them in a few. The County does not enforce your CC&Rs, and your CC&Rs do not excuse anyone from a county rule.

Water, sewer and recycled waterThe Tesoro Viejo Master Mutual Water Company provides service, and Cal Water operates the systems and answers the phone.

Water utility service in Tesoro Viejo is provided by the Tesoro Viejo Master Mutual Water Company. Cal Water’s district page says Cal Water operates and maintains the water, wastewater, recycled water, storm water and agricultural water systems on the company’s behalf, and handles customer service through its Selma customer center by phone or email. There is no in-person counter.

Cal Water began delivering recycled water to the company in 2021, for community landscaping and farm irrigation. If your association irrigates common areas, ask which meters are on recycled water and which are on drinking water. That will matter for the 2029 turf rule below.

The company’s board adopts the rates by resolution, and Cal Water labels the rate sheet unregulated. The resolution adopted December 24, 2024 bills monthly:

ChargeRate in the April 1, 2025 schedule
Monthly service charge, 1-inch meterSee the current rate schedule; owed whether or not water is used
Water use, tier 1$1.99 per hundred cubic feet
Water use, tier 2$2.81 per hundred cubic feet
Surcharge labeled MID$2.33 per hundred cubic feet
Sewer$43.05 per unit per month

What to do about it: put utility costs for common areas into Planning Your HOA Budget, and track irrigation and pipe work in Understanding HOA Reserve Studies.

Watering schedule and turfOutdoor watering is limited to set days by address, never on Mondays and never between 10 a.m. and 7 p.m.

The Tesoro Viejo Master Mutual Water Company’s board adopted its watering schedule as Resolution No. 21-01, effective May 3, 2021. Cal Water still posts it on the district page:

SeasonOdd-numbered addressesEven-numbered addresses
Warm weather, April 1 to October 31Tuesday, Thursday and SaturdayWednesday, Friday and Sunday
Winter, November 1 to March 31Saturday onlySunday only

Two rules apply all year to every address. All outside water use is prohibited every day between 10 a.m. and 7 p.m., and outside water use is not allowed at all on Mondays.

Common-area controllers have to follow the same schedule. Write the allowed days and hours into your landscape contract, and check which address each controller is billed under.

A state law passed in 2023 (AB 1572) bars the use of drinking water on nonfunctional turf in HOA common areas starting January 1, 2029. On owners’ own lots, Civil Code section 4735 prevents an association from banning low-water plants or artificial turf.

What to do about it: put landscape changes in your numbers with Planning Your HOA Budget, then compare bids with the Vendor Comparison Worksheet. For the California rules behind these projects, see California HOA maintenance and repair responsibilities and California HOA reserves.

Special districts and special taxesCounty Public Works lists a Tesoro Viejo service area in its special district budgets, separate from your association dues.

Madera County Public Works runs many small special districts that pay for local services in unincorporated areas. Its June 10, 2024 memos on the 2024-25 budgets list Service Area 22E, Tesoro Viejo, in both the special district budgets and the special district road budgets.

Public Works says its special districts operate as enterprise funds that should not be supplemented by the County’s General Fund. We could not open the budget pages that describe what Service Area 22E pays for or charges, so this guide does not list them.

We also did not find an official list of community facilities districts (Mello-Roos) covering Tesoro Viejo. Check the direct charges on a Tesoro Viejo property tax bill and the disclosures from the original purchase to see what applies. Before you take on maintenance of a street, slope or park, confirm in writing whether it belongs to the association or to a County district.

Short-term rentalsThe County is still working on a short-term rental permit ordinance, and operators already need a business license and an occupancy tax certificate.

Tesoro Viejo is not a city, so County of Madera rules apply. When we checked, the County Planning Division’s page said Madera County currently has minimal regulations governing short-term vacation rentals. It listed revised drafts of a new ordinance dated May 7, 2025, July 23, 2025 and January 30, 2026. It did not show the ordinance as adopted.

One rule already applies. The County Treasurer-Tax Collector says anyone operating a short-term rental needs a business license and a transient occupancy tax certificate, with a separate application for each property. Operators must file a quarterly tax return even in a quarter with no rental income.

The draft ordinance posted on the County’s page would add these rules. They are proposals, not law, until the Board of Supervisors adopts them:

Annual permitan owner would need a short-term vacation rental permit before advertising, renewed every year.
Occupancy limitsfour guests in a studio or one-bedroom, rising by two per bedroom to 12 in a five-bedroom home.
Parking and noiseno guest parking on the roadway, and guests would have to follow the County’s noise chapter, Chapter 9.58.
24-hour contactthe owner or an agent would have to answer the phone around the clock and be able to reach the property within one hour.
Association approvala condominium, single-unit home or other unit managed by an association would qualify only if the association authorizes the rental and enforces the occupancy rule itself.

That last point matters to boards. If it is adopted as drafted, a County permit for a home in your community would depend on your association’s authorization, and your association would carry the enforcement. Decide your position before owners start asking. Separately, California Civil Code section 4741 does not stop an association from prohibiting rentals of 30 days or less.

What to do about it: How to Handle Short-Term Rentals in Your Community walks through writing and enforcing a rental rule. For longer leases, see Renting Out Your Home in a Homeowners Association. For the California rules, see our guide to buying, selling and renting in a California HOA.

ADUsThe County offers pre-approved ADU plans, and state law limits how far an association can restrict ADUs.

The County’s Building Division offers pre-approved ADU plans to owners in unincorporated areas, in four sizes: 375, 550, 775 and 908 square feet. Its ADU page also posts a how-to guide and the building permit application. We could not open the County Code’s ADU standards, so check sizes, setbacks and utility connections with the County before you rely on any answer.

In Tesoro Viejo, ask the water company through Cal Water early about water and sewer service for a new unit.

Civil Code section 4751 makes void any rule in your governing documents that effectively prohibits or unreasonably restricts building an ADU or junior ADU on a single-family lot. Reasonable rules, such as design standards, are still allowed. If owners can use a pre-approved County plan, make sure your architectural review process can handle the request quickly.

Fire protection and defensible spaceMadera County Fire runs under a contract with CAL FIRE, and CAL FIRE’s defensible space guidance covers 100 feet around buildings.

The Madera County Fire Department serves the 2,153 square miles of unincorporated Madera County. The County says the department is administered, and its career staff provided, through a contract with CAL FIRE. It has 14 fire stations. Its fire prevention program includes fire code enforcement.

The State Fire Marshal’s fire hazard severity zone maps for State Responsibility Areas took effect April 1, 2024. Maps for Local Responsibility Areas were released in phases in February and March 2025. The zones are moderate, high and very high. We could not confirm the zone for Tesoro Viejo addresses, so look up each common-area address in the State Fire Marshal’s map viewer, especially open space and edges next to undeveloped land.

CAL FIRE’s defensible space guidance covers up to 100 feet around a building, in three zones. It says Zones 1 and 2 are required by law, and that local rules may be stricter:

Zone 0 (0 to 5 feet)not legally required yet. Use gravel or pavers instead of combustible mulch, and move firewood, trash bins and parked vehicles out of this zone.
Zone 1 (up to 30 feet)clear dead plants, leaves and needles from yards, roofs and gutters, and keep branches 10 feet from chimneys.
Zone 2 (30 to 100 feet)keep annual grass no taller than 4 inches and space trees and shrubs apart.

When a home in a high or very high zone is sold, state law can require the seller to give the buyer documentation of defensible space compliance, or to sign an agreement for the buyer to get it, depending on whether the local agency has an inspection ordinance or offers inspections (Civil Code section 1102.19).

We could not find a County weed abatement or hazardous vegetation page, so this guide does not describe County inspection dates or abatement notices. Ask County Fire Prevention before fire season.

Trash and organicsTwo County franchise haulers split unincorporated Madera County at 1,000 feet of elevation, and SB 1383 rules apply from July 1, 2025.

Unincorporated Madera County has two exclusive franchise haulers, split by elevation. Red Rock Environmental Group serves the Valley Area, below 1,000 feet. Emadco Disposal serves the Mountain Area, above 1,000 feet. The County’s Waste Collection Service Look-up Tool shows which hauler serves an address.

The County says businesses and multifamily properties with five or more units must have an organic recycling program (AB 1826). Its SB 1383 page says all property owners in the County’s SB 1383 compliance area must comply starting July 1, 2025. Owners can subscribe to organics collection, self-haul food waste or manage it on site. Residential property owners do not qualify for waivers.

If you subscribe, you must use the hauler’s containers. Food scraps, yard waste and food-soiled paper go in the green container. Plastic bags and compostable plastics do not.

Quick answers

Questions Tesoro Viejo board members ask

Is Tesoro Viejo part of the City of Madera?

No. Tesoro Viejo is in unincorporated Madera County, so County of Madera rules and departments apply. Madera County Fire, which runs under a contract with CAL FIRE, provides fire service.

Is Cal Water our water company?

Not exactly. The Tesoro Viejo Master Mutual Water Company provides the service and sets the rates. Cal Water operates the systems for it and handles customer service at (559) 896-4546.

When can we water?

From April 1 to October 31, odd-numbered addresses water Tuesday, Thursday and Saturday, and even-numbered addresses Wednesday, Friday and Sunday. From November 1 to March 31, odd addresses water Saturday and even addresses Sunday. Never on Mondays, and never between 10 a.m. and 7 p.m.

Are short-term rentals allowed?

The County has only minimal rules today, and it is still working on a permit ordinance. Operators already need a County business license and a transient occupancy tax certificate. Under the draft, a home managed by an association would qualify for a permit only if the association authorizes it. Your association can also prohibit rentals of 30 days or less in its own documents. More in How to Handle Short-Term Rentals in Your Community.

Is the special tax on my bill part of my HOA dues?

No. Charges for County special districts and any community facilities district are separate from your dues and are usually collected on the property tax bill. Your association does not set or collect them. See What Assessments Your HOA Community Needs and Why.

Who picks up trash in Tesoro Viejo?

The County has two franchise haulers, split at 1,000 feet of elevation. Use the County’s Waste Collection Service Look-up Tool to confirm which one serves your address.
